”The arguments proposed by the Petitioners were actually manipulated from the Petitioner, as if the Petitionee had made mistakes and violated the rules within the legislation,” explained Fadillah Hudri Lubis as the Petitionee s Legal Counsel, the Regional General Election Commission in South Tapanuli.

That was delivered in the second trial on South Tapanuli Election Dispute in the Constitutional Court, Wednesday (17/12). Case No. 55/PHPU.D-VI/2008 was filed by a candidate pair in South Tapanuli Election, Drs. H. Rahmad Pardamean Hasibuan and Drs. H. Aminusin M. Harahap, AMK.

In the arguments, the Petitioner considered the stages in the election had been against the law, for example, Petitioner s witness did not receive the C1 form, some people were not listed in the Temporary Voters List, Fixed Voters List and not receiving the invitation to cast their vote, “there were things or many give away with a consequence to vote for Candidate Pair No. 7 and some other violations which influenced the result of the recapitulation,” said the Petitioner s Legal Counsel, Andi M. Asrun.

Responding to the statement from the Petitioner, Fadil explained that the Districts suspected to have such violations were, Barumun District (Pasar Sibuhuan Village), Ulu Barumun District (Paringgonan Village and Sibual-buali Village), Sosa District (Hapung Village, Sungai Jior Village, Mondang Village, and Sisoma Village), Huristak District (Bonang Village and Tanjung Morang Village), and several other districts were not true. He mentioned that the corrections reported from the Petitioner did not influence the vote result for each candidate. “Over the DA1-KWK form, it turned out as a result which did not have a great influence in the vote recapitulation,” emphasized Fadil

The trial which was originally also scheduled for Verification of Evidences was adjourned to Thursday (18/12), due to the Petitioner s witnesses unready. (Andhini Sayu Fauzia)
